Cigarette basically discontinued the Gladiator last year and the vice about the same.

It is against the law for CIG to use your photo for commercial gain absent your consent - have them take it down, get your permission or sue them.

We have requested that they take it down immediatley. We are awaiting a response.

We had the same situation with Donzi who wanted to use an historic photo. However, they came to us and asked for a way they could use the photo for commercial gain and we worked out something with them.

In this case the photo was just used without asking.

I agree what's the big deal with them using the pic. Did you pay for the pic to begin with. Does the deceased don get the proceeds, otherwise the photo or any photo should be able to be used.

If I'm missing the big picture I'm sorry. But these old photos are historic, but in the same token the photos should be the rights of who are in them. I'm probably all wrong, but unless Don comes back from the grave and asks for money then I don't see a problem with it.

The only one who can ask some $$ for the rights , it's the person who cliked the picture. (Int.l law ) or Don's son Michael.
