I agree what's the big deal with them using the pic. Did you pay for the pic to begin with. Does the deceased don get the proceeds, otherwise the photo or any photo should be able to be used.
If I'm missing the big picture I'm sorry. But these old photos are historic, but in the same token the photos should be the rights of who are in them. I'm probably all wrong, but unless Don comes back from the grave and asks for money then I don't see a problem with it.

The photo is owned by the estate of Don Aronow.
Permission to use the photo was given exclusively to HORBA, with the use being supervisied by the estate.
We have used it to promote the history of both Don and the sport on our website and in stories in various media.
The point here is, if someone uses it without permission for their financial gain, that is not allowed.
If you think that is not a big deal, start selling t-shirts with the Cigarette logo on them and see how quickly they contact you.

I seriously doubt the use of the picture earn $1 more of revenue. Seems pretty petty to me. They are just acknowledging their heritage. If I were a member of the Aronow family, I would appreciate them recognizing Don's continued impact on the company.

I am sure there is more than one copy of that photo. And, if there was a another copy that belonged to the factory, don't they have the right to use it? Just asking.
