Default engine warranty issue

here is the story.
spring of 05 we purchased a used boat in Fl. from a dealer/broker.
the ad read, fresh rebuilt motors warrantied thru july of 06.
well sometime in july both motors crapped out.
the dealer started to help out, then would not return any calls.
we pulled motors appart and it turns out they looked like they were never rebuilt.
so the question is, am I screwed or do I have any legal recourse?
any Fl attorneys out there?

Not a lawyer, but if you have it in writing on the sales agreement that the engines are under warranty till July 06 then you're covered.
If all you have is an ad for the boat stating that the engines are warrantied then you may have a fight on your hands.

What engines??????

The warranty would be through the engine builder. I would have made sure on that one prior to purchase.

merc 502, I have been getting the run around from all parties.
dealer, seller, builder.

Sorry about your luck. Chalk it up to experience. No recourse on your end. The only thing to do is sue the parites invlolved. This will be costly and take a long time. Also not likely to even be able to collect the settlement. Went through this and was a $50,000 lesson.

Is the warranty described in the sales contract or the in the advertisement?
Who warrantied the rebuilt motors?
Did you notify the "right" people that you were filing a warranty claim as detailed in the warranty information (assuming this exists)?

These questions will help clarify whether or not you have a fighting chance to get this issue resolved to your satisfaction.

Worst case - the word warranty is mentioned in the ad only - your probably hosed.

Best case - it's all detailed in the sales contract and the company that warrantied the motors is a standup company - you may have a case to get your engines fixed under warranty.

Good luck.

BTW - does the warranty information state who must "pull" the engine apart? You may have violated terms of the warranty (again, only if it exists).
