Excuse me, I hadn't pulled a tape on it, just looked at the original build documents where it said length 38'. I've been lied to about everything else so why should I think they would have told the truth about the length.

That boat is/was pretty well known here on OSO. It was re-rigged by one of the best in the business. It did a brief stint with Pulse drives before getting a complete transom redo and back to Merc drives. I was trying to convince a good friend here in VA to buy that boat last year. It did not look like that in the pics of when it was for sale last year, and that is an utter shame to see the boat deteriorated so such a shape.
