No, he's not alright, in fact he may lose all his money and the boat.

Don't give advice when you know nothing about liens and how it works.

If you just gave all the money to the seller and didn't check for liens and didn't pay off the loan directly, you have significant risk of losing all the money paid to the seller and the boat as well as still owing your note to your bank.

You need to act now if you haven't already. 5 months is 4 months and 3 weeks longer than you should have let this langusih. Likely the seller has spend the money and you're going to get to buy the boat again from the 1st lien holder or give it back to them, all while paying off your unsecured note to your bank.

You don't even know if his story is true at all....if he only owes 4K, then you may need to pony up that to get clear title, because what probably happend is, if he did pay on the loan, but not pay it off, it's accrued an additional 5 months interest on the balance, now hopefully that balance is only 4K but it's still more money owed before the lien is going to get paid before you get title.

Get moving ....NOW..you're being pretty casual for a guy that may lose $40K to the seller plus $40K to your bank.

Does anyone think if he has been out of work for 7 months and got his hands on a $40K check he actually went to the bank and put all that money on the loan?

I'm thinking when you do find out how much is owed on the boat your going to sh!t your pants.
