Unfortunately, ethics and laws don't always line up. If someone could get those two things on the same track, the world would be a better place.
I hope this gets resolved in a manner where both parties are satisfied. |
One last question before I go to bed.I have an E-BAY item number.But ebay says the item is no longer stored on file or something like that.Its the number I beleive to the sale of the cat and I may need this for evidence.Is there any way to retrieve this info from E-BAY?????

DUDE! How can you justify that much money on a sale that didn't happen? I would really like to know. The one thing that cannot be bought is a good reputation. I have lost quite a few bucks in my life when I wasn't wrong to avoid souring my Rep! These were caused by low lifes that were sleazy along similiar lines. I have dubbed this as reputation tax. How much is your reputation worth? This is something that can and propably will follow you to your grave(not a threat but meaning it will plague you the rest of your life). Please do the right thing!

More than likely he doesnt have the money to pay him back. :mad: However looks like he has enough assets to cover the bill.
I sold car once that I considered to be in immaculate condition. A week or so after the sale, the new owner called demanding his money back. He did some searching and found out the car had been pieced together, something I didnt even know because it looked flawless. In the meantime, I had already spent the money on another car and didnt have any spare money back then. I ended up taking out a loan to make it right with this guy to buy the car back even though I had done nothing wrong. |

I have no dog in this fight but right or wrong contract or no contract this is NOT chump change. Why not start a poll stating the facts and let this be the deciding factor? If this was me he would have received his money back along time ago. I sleep well at night...do you? |
Dong's real problem on this is that his actions clearly constitute bad faith. I don't know of a state in the union where actions of bad faith aren't provided the remedy of treble damages. $12K becomes $36 grand.

Also, these 2 are $2500 apart from an agreement. Neither of these 2 parties will be getting that amount after the lawyers are done w/ you. |

Contract was written to MY time frame on when I had to pay my loan on the Fountain....Prostock agreed and signed the deal. Prostock didnt pay by the date 6/13/08 (Friday) and didnt offer to pay the balance until 6/16/08 (Monday)..... It might be "one business day" but there was two days (Sat & Sun) he could have picked up the phone and say he needed to work out something different....by the time Monday rolled around other arrangements had been made... Anthony, you too are withholding information to make me look like the bad guy....Like stating it was "ONE DAY" later I shut the door....In fact it was 3 days later and Prostock hastn called me since he sent the $12k....ALMOST 6 MONTHS AGO.... Now we are all in bad financial times 6 months after the deal and your on a witch hunt to prove something?....like I said I'll wait for my day in court... For the rest of you bandwagon jumpers keep my wife, kids, inlaws, and personal situations out of this....it has nothing to do with this transaction. P.S. If a court of law found in Prostocks favor, trust me I can stroke the check to cover it.....Its not the best time to write it, but I could do it if I absolutely had too... |

so you sold the boat on e bay by 6/15 for 17600? If not, then it seems kinda funny that you would refuse 26500 by monday morning, the the 16th and settle for 17600 unless you were using the 14 plus 17 method in figuring what you ACTUALLY got for the boat doesn't it?

The final payment was due on Friday 6/13/08, I didnt shoot down the offer to pay in full until Monday 6/16/08 when Prostock didnt contact me ALL WEEKEND to try and make different arrangements!....Yes it is "One Business Day" from Friday to Monday...BUT there was Saturday and Sunday that Prostock had ample time to call me and make a different arrangement!.....He never contacted me so I had to make other arrangments...as stated in the PM I sent to him.... Friday to Monday is 72 hours in which he could have called, PM'ed, or emailed to make different arrangments...He did NOT! |
