Run over by a 53 foot carver. Need advice.

There is barely any current in Smiths! Did they do a sobriety test on him? Its a bull**** deal on his part regardless. Anyone that owns a 53' Carver should be able to take care of the situation. I would have shot the SOB with my flare gun!

I wasn't there, but, it sound like another rich A-hole who can write a cheque and do very little else, 53ft Carver and he couldn't handle the currents? Was it during a hurricane??
I would lawyer up to, I'm surprised the guy with the Carver hasn't tried to have you charged for damaging his boat, best to be proactive and cover your ass

Just keep in mind, if you get a lawyer, you're going to be paying this guy out of your own pocket. The other guys insurance isn't going to pay you more money just because you got an attorney. If the company that insured the Carver opened a claim and is willing to pay, and is going through the the process, other than not getting it processed as fast as you want, or quick enough so that you can go on vacation with the boat, what's your complaint? And what do you think that a lawyer is going to do? I'm just curious. I always hear people say "lawyer up, or I'm going to get my lawyer", when they don't even have one, they hire one to watch over something like this then end up owing a few grand for really nothing. Now if you're getting blown off and the insurance company told you to pound sand and they don't want to fix your boat, then by all means, get a good lawyer and go after the owner of the Carver and the insurance company. I heard about this jack ass. My neighbor was down there and saw the whole thing happen. Said the boat kept pushing forward after he hit the line of boats. You could see the prop wash as he was still in gear. I can't believe the cops let this guy go. There's absolutely no current in this spot. Smith bayou is a small cove on an inland lake where many boats tie up together. Good luck man, I hope it works out for you.

You should find an attorney that is familiar with and practices Maritime Law. The standards of responsibility for the operator of a vessel are different on water vs on land. Most cops are not very familiar with Maritime law either. Coasties should know proper procedure...
