1. In New Jersey the convicted DUI?BUI must attend the Intoxicated Driver Resource Center (IDRC) "drunk driving classes/education - that cost money
$100 attendance fee MVC
$230 first offender fee IDRC
$280 second offender fee IDRC
$100 license restoration fee MVC
2. MADD has a speaker at those centers, MADD get funded by the government
3. New Jersey Motor Vehicle Commission (not the court) imposes a $1,000 a year surcharge for three years = $3,000
4. Plus the fines, plus an ignition interlock if your BAC is greater than .15 BAC or a Refusal for a period of six month to one year...$65/month +/- plus installation
5. Fines...

The drug cases are becoming more prevalent, cops are getting better training, whole lot of pill heads getting pinched (Jersey talk for arrested). The DRE (a Police Officer), Drug Recognition Expert helps determine the substance that is causing the driver to appear to be impaired...getting technical now

Now I need to take your advice, I never should have posted about the 22 year old, and the 31 year woman I would have been out on a date with; well my date was cancelled, two girls are pissed at me, both did not like the fact that I posted anything about them....I need to my mouth (posting on the Internet) shut !!!

Let me see if I understand this. Here on OSO whenever boating and alcohol are mentioned, 99% of the members are quick to post how in no way do they EVER touch a drink while boating and are quick to voice how only the ignorant idiots boat and drink. Never minding the drunk boater just may be in an accident with 1 of the other 5 boats in there path. Now we are having members ask how to beat the breathalyzer test and drinking and driving road blocks cause they've had a few drinks and are now driving on the road where there is the possibility of causing an accident every 20', and now getting tips on loopholes. Course, I'm sure those asking are only concerned about the risk of error for being stopped when not a single drop of alcohol has been consumed.

When I was boating in the 15' Boston Whaler I would drink beer while boating, I wasn't getting annihilated, but I know dam well there many days when my BAC may have been close to or even possibly above the legal limit, not by much but I may have been above the BAC limit of .08; however, I drove that boat sensibly, kept a low profile, just enjoyed my time and my company with me in the boat..it was truly stress-free boating.

Now when I was operating the Phantom, Magnum or Donzi, I would only have a few beers over the course of the whole day out on the water, I was always looking for a race, wanted to be on top of my game, not risk my life or my passengers life, not break anything, and not hurt any other boater out there, or more likely to avoid being run over by some yahoo that just drank a twelve pack of 16 ox beer. And I was with my father in all the boats except for Donzi, and they were his boats so I wasn't drinking much. I did not drink much in the Donzi, but the reasons were I was in my early 20's at the Jersey shore, and the NJSP pulled me over three time for safety checks, really looking for a BUI, so that was not a low profile boat, I was young, I was a target.

The issue with driving a car, many will go out to dinner, get a few cocktails, enjoy the evening then drive home. Then be pulled over, the "odor of alcohol is emanating from the car" then the DUI is on. The police love to used that phrase, " "odor of alcohol is emanating from the car" to justify the filed sobriety testing and DUI suspicion. On the water in an open cockpit boat, at least the odor is being instantly dispersed.

Maybe that addresses your thought(s), but you are correct, many on OSO do not drink while boating, maybe for some of the reasons I just mentioned.....that is why I didn't drink much at all, in the hot rods, but in the Boston Whaler, I would drink beer....but responsibly.

Answer to #1. You must comply with the Officer's instructions, if he asks you to exit the vehicle you do, but you do not have to submit to the filed sobriety tests in New Jersey, that is not Refusal. The officer will most likely charge you with DUI, if you look and smell as if you are impaired. Refusal is refusing to submit to the breath test.***

Answer to #2. The 22 year old knows people I know, and she knows the 31 year old, too many rats.....(informants), people like to talk-gossip...

***This is in New Jersey, I do now know any other states rules, regulations, or court system regarding DUI stop(s).
