1) got a call to be at a bar.... ex girlfriend I have not taled to after the day she moved out got the same call...... I have a girl she HATEs with me.....CRAP 2)$300 bar tab.... CRAP 3)hot tub party call... gotta ditch this chick... CRAP 4)65 in a 35..... LIGHTS/...... CRAP 5)wanna sit in the back of my police car??.....CRAP 6)call.... nakid chicks in the hot tub... where are ya??? CRAP 7)CRAP 8) 3 captain cokes my ass.....CRAP 9)you wanna blow or go to jail..... CRAP 10) I was hoping you were my neighbor officer ,,,,,,,,,kinda crap 11)you know this is more than the legal limit in Michigan?? OH CRAP 12)has she been drinking as much as you??? CRAP 13)YOU HAVE A CCW?!?!?! WHERE IS YOR GUN?? CRAP CRAP 14)I want her to drive your car... "you want HER to take MY car??" A little advice compiled by friends who are attorneys and deputies.
1. Don't drive drunk. If you do: 1. If you notice a cop following close behind you, drop a little below the speed limit. If he does not pass, he is probably observing you. Pull over before he puts on his lights. This works in your defense because he had no probable cause to make the stop. 2. Do not say anything and whatever you do, Do not blow! Simply ask if you have done anything wrong. Then ask if you are under arrest. Inform the officer that you will cooperate fully after you are able to speak with your attorney. Most likely you cannot get ahold of your atty at 3am on a Sunday. If you have been drinking and are in an accident hopefully you are close to a store. Run and get something with alcohol in it and drink it in front of witnesses possibly in front of the first officer to arrive at the scene. Let him know you needed something to calm your nerves. This is not legal advise, I am not an attorney. But, it will work. |
Gator, I don't know about Florida, but here in Jersey the penalty for refusing the breathalizer is the same as it is for DWI.

In ohio refusing is mandatory 3mo. suspension first off. 6mo. if second. knowing this sucks.

Always have an unopened pint of Jack on the seat next to you. When the cop comes up to your window, break the seal so he/she can see and pound about half of it. They will have no idea whether or not you were drunk before or after the half pint you just swigged. :D

Don't refuse to blow. Let him know you will cooperate fully once you have spoken with you atty. Do not admit to anything.
As far as slowing down, I would not slow drastically. at or just below the speed limit. Then, make sure you pull over before you see the blue lights. Illegal consumption is not as stiff a penalty as DUI. Sometimes you have to pick your battles. I actually know a guy that rear ended a lady, drove home, parked in the backyard and made a drink. The lady gave his tag # to the police. When they showed up at his house, he said he panicked and went home to call his brother (an atty). He told the cops his brother said to have a drink to calm down and cooperate fully with the police when they showed up. His charges for careless driving and leaving the scene were much less than a DUI would have been. |

Also if the cops are following you, one thing they look for big here in ohio is if your staying in marked lanes. I guess I am always drinking and driving cos I never stay in marked lanes!!

with my vette, it was better than the dui :eek: also outran quite a few of them:crazy:, always had my police scanner in the car, they would still come to your house and try to drag u away though, 500 bucks to my lawyer took care of that ,no charges!:D BUT THEY WILL START PULLING YOU OVER FOR ANTHING:( CAUSE YOU PISSED THEM OFF.:mad: END RESULTS , I SOLD THE CAR IT HAD A BAD REPUTATION:D :D |

I agree don't take the chance. I would like your response to a piece of advice given to me by a Police Lieutenant certified to administer breath-alyzers and also my brother. If stopped and you know you are drunk refuse all field sobriety tests and ask to take the breath-alyzer. Take a deep breath belch to bring raw alcohol into your mouth then blow. The test will not register due to the raw alcohol. Put down the tube and state you have complied fully with the law. You will probably be charged but without field sobriety evidence or actual failure to take the test you have complied with the law and there is no actual evidence to support the fact you were intoxicated. I know you have no desire to tell people how to get out of a DUI if they are taking the chance of taking a life or killing themself, I just wondered. |

Hear in Mass, and my only experience to this is a case I sat in on at Jury Duty, is that if you refuse the breathalizer that is inadmisable in court????? Odd deal I thought, but he Teddy buttface Kennedy has to protect himself some how!!!!! So if you refuse the test you are more of less going to get a lighter sentance or even get off all together. You will loose your license for I think it is 40-90 days (can not remember) but after that you are set. Seems stupid but I know plenty of people that play that game including a freind that her drunk driving finally cought up to her and she drove off the road, totalled her brand new truck and messed up her face on the wheel she was so messed up!!!! She refused the breathalizer, and today is driving around doing the same stupid ****!!!! :( :( |
Kepin mind everyone #1 on my list was don't do it. I don't condone it and don't do it myself if I have been drinking quite a bit. Alcohol affects everyone differently. Here in Fl the level is .08. I am told that is approx 2 beers per hour for a man my size (6'1" 130 lbs). At that point I am not a "drunk driver". I also closed by saying that I was not giving legal advice. I have several friends who sit at both ends of the courtroom, cops and defense attorneys.
Troutly, you obviously are more sohisticated with these intricacies than the avg cop. I would venture to guess that you may qualify as a DUI expert and probably serve on some sort of task force related to this. What will not work on you would probably still work on the average officer. |
This seems to be a popular subject lately (the holidays I guess). Not trying to be a smart a$$ here but why all the gimics to try? There not going to work. How about just using a designated driver if people are gonna be out drinking? Seems simple enough...

Does it get drunk and shoot pool with you? Does it check itself into the Betty Ford clinic? or Does it start one of those chain-reaction pie-eating contest puke-a-thon's where everybody gets sick from seeing it and pukes on the guy next to them? |

But I'm with Audio, next time I go to the bar I'm gonna ask for one of those "Intoxilyzer 5000's" it sounds like a great drink for when you just want to get wasted :D :D |

Srobak is right, this guy should be imprisoned for multiple decades. If you have more than one DUI you should also get a pretty good smack, but thei first time DUI at .08 stuff is really impinging on government intrusion. So are DUI checkpoints. I guess the summation is, discretion needs to be used. If you are getting hammered and driving, then you need to be held accountable, period. If you keep getting DUI's then you need to be held accouttable. But if you are out with the wife and kids and blow a .08 for goodness sakes, man......that is really really iffy. Now if you are coming home from the ballgame with the kid standing on the front seat with no seatbelt on (I THINK THAT IS MUCH WORSE THAN ANY .08 DUI......AN UNRESTRAINED CHILD!!!!! I HATE THAT) and you are like .18 or something, then yeah, you need to be punished. Hope all this rambling makes sense to someone other than me.......HeHeHe...... :D :D :D |
You guys are just not drinking enough. Once you get over .36 you are legally dead and cant be prosecuted. I think I am never under .1.

Allan4, I agree with you. The information that I have compiled is mostly for my benefit as I do not drive "drunk". Although I am sure if stopped at the right time I could have been legally intoxicated many times. When I do my serious partying I normally have a dd. If I stop by a clients rest./bar and they offer a drink or 2 I don't see a problem getting home.
I would also like tostress again, do not drive while your drunk. |
I totally agree that driving while drunk is bad. I also think that 50% or more of the people driving are driving as poorly if not worse than the recreational drinker, especially those on other forms of recreational drugs, cell phones, food, children and makeup. I do have a problem with the criminalization of something deemed wrong BEFORE anything wrong happened. Lets see, I own a gun, Well, that might go off and shoot someone so I should be arrested before that happens?? If I cause a wreck or kill someone, and Im drunk, hang my ass, otherwise leave me alone, its none of your business to decide what might happen. I drive 1000 miles a week frequently and the behavior I see on the roads just amazes me. I never thought Id say this, but we need many many more police on the roads enforcing existing laws. I frequently see drivers on the Ohio turnpike in excess of 80 going by troopers in the median and they dont even blink. Never mind Rt 95 on the east coast which might as well be renamed something more appropriate to a race track or demolition derby. Done venting now.
