Allstate is the absolute worst in NJ. If you have collision, go through your carrier and let them file for subrogation vs. Allstate. I would suggest that you file pro se if it can't be resolved b/c too small of a claim to get attorneys involved. (Trust me I know, I'm an attorney and I know how expensive it can be to litigate w/ Allstate). Good luck.

I would involve my own ins co as a last resort. The repair shop will make the adjustments you are looking for. No need for your carrier knowing you were in an accident that wasn't your fault. After several of these they will consider you a bad risk.

You hear a lot of complaints about it but that is exactly why i like Michigan's no fault insurance....regardless of who is at fault in the accident your insurance pays for your vehicle then you don't have to deal with a company that doesn't represent you.
I don't know how your insurance works but i would think you would be entitled to at least get a few estimates from different body shops to assess the damage.

As far was wanting the car totaled, this is just a matter of economics. If the car value is worth more than the repairs, they are going to do the repairs. If the car value is less than the repairs, they will total it. Now if they underestimated the repairs, that is another story, and that needs to be corrected before a decision is made to total the car or fix it. If you want the money instead, talk to them, tell them you will take the repair costs, and they can have the car. They may agree. But don't expect them to pay you more than the cost of the repairs or the total value of the car, whichever is less. You don't have much of a case to expect them to pay you more than the repair costs just because you don't want the car anymore. They can argue they will fix the car, then you can sell it.

I see your point about them not paying more than the repair of the car or the fair value. But I sincerely believe after todays round of discussion with Allstate/their choice of shop. they are trying to pull a fast one. We already notified our insurance and they sent a estimator over to check the car out and do his own estimate and guess what they said it wasn't there and wouldn't let him look for it in their lot
(what the %^&#) then they called again and wanted permission to start repairs
I mean they are all lying.
As for the claim we just whats fair?? I think it is fair to get more than just their opinion on the damage to the car, I also think it is fair to include ALL DAMAGE that can be seen and put back with HONDA parts. I sincerely think if the estimate was done that way their is no question it is totaled.
I have delt with Nationwide, Geico, and Erie on other claims and never given such a load of SH*$ as ALLSTATE

If you don't have faith in this shop then you should simply have the car towed to a different shop. Doesn't matter if they are honest or not, you have lost faith in them. If you authorize someone to do work you don't trust then you can't complain later if the outcome isn't what you'd hoped.
