Just curious, if someone were going to file a large lawsuit against someone like Haggin, would an attorney advise you to post all kinds of potentially slanderous comments in an online forum.? What if, lets just say, you were to lose your case against Haggin. Lets just say he filed a counter suit against you for at the least slander, wouldn't your posts here potentially open you to litigation of slander, harrassment, defamation of character. I think if I were in your position I would be a bit more cautious about how you proceed from here. It would seem you are giving Haggin's very capable lawyers a significant amount of ammo. Don't go away mad, just go away. You are bothering us and we have nothing to do with your little legal action. Maybe a moderator can make this guy go away

The first to use a distinctive mark in connection with a particular set of goods or services has legal rights to that mark. Dates are important for various reasons, owners of a trademark registration, or those seeking to obtain registration, must remember that the senior user who failed to register its mark still has superior rights to the mark, despite the fact that they are now the owner of trademark registration for the mark. While federal law provides a statutory priority date at the time of filing, common law dictates that the first to use the distinctive mark in commerce has priority rights and will prevail.
The AMF lawyer was well aware of my use of the mark in commerce in connection with promoting/marketing the sport of racing and, unfortunately, acted in bad faith when she proceed with AMF's application to obtain registration for the mark while completely disregarded the law. It is unfortunate that AMF has taken a stance to ignore this issue, and the laws that stand behind it.
If what I post here is ammo for potential litigation of slander, harassment and/or defamation of character, all I can say is, BRING IT ON..... IT IS NOT MY CHARACTER AT STAKE.

Ingoring something of this nature simply will not make it go away. By the way, It was Mr. Haggin's sinister lawyer, Deborah Berkowitz, that put AMF in this position. In time the truth will come out and this matter will be resolved and closed.
