In all seriousness, I asked that very same question at the boating safety course.
"If a DUI was to be issued to a person in a boat that had 1 helm and a set of throttles controlled by a 2nd person, who get's the DUI ?"
The answer I got was, "The guy behind the wheel."
Let's not forget though, if you were in a car and had nothing to drink, but you let someone drive that was legally intoxicated, if I am not mistaken you can be charged with something.....

As long as you carry a certificate from your home state you are fine.
Even if your state does not require it, you need to have a certificate for a boater safety course.
When this was being proposed my 1st question was how was this would be enforced being as NJ shares the Hudson River with NY , the Delaware River with PA and the Delaware Bay with DE. As far as I can remember, that was the answer. The operator would need one from their state if they were to boating on NJ waterways.

It effected racing from the beginning depending upon the participants age...
If you had a young person racing, they were required back then too. Now that everyone needs one, they will now be looking for it. Let's not forget, this state is looking to raise $$$$$.

They hydro race was in a contained body of water with only racers on the course and saftey boats on the shore ready to launch.

You do not need one if your race site has a Coast Guard permit,( It over rides a state permit).
The apba race you talk about need a state permit only ,
Any race that has a Coast Guard permit is OK.
