Boat Manufacturer + Dealer = New MSO?

Need some help here guys:
Let's say you have a 2002 race boat, that was coverted to a pleasure boat in 2006. Is it legal to restamp it as a 2006, make a new MSO, and sell it as a brand new 2006 and not tell the buyer???

Once it's sold and leaves the factory you can never change the number.
How did Randy treat you on that fuel cell?

I think the question was: can you re-rig a few years later and make it a newer model year.
The answer is no.

Yes, in that specific situation you are probably correct. But manufactures due change things if they mess up
