Is this...person...illegally in the country, I wonder? It really seems that he had a lack of grasp of English and none of the typical documents necessary for driving, and thus perhaps the requirements for towing, etc. If so, it is CERTAINLY not his fault for this accident...nay, rather WE bear the blame for not understanding the possible plight he was in.

He was most likely Hotshotting as a commercial carrier, but if he was under 26001 a CDL would not be required. I am betting the trailer weighs 5000 and the truck 7000 so that leaves 14000 for the boat. Still need a up to date DOT medical card even if you are under the weight requirement for a CDL if you are hauling for Hire.
No functioning emergency detach for the brakes is a Huge No No.

My older brother is a Nut. He loads his 1985 39 foot Searay on his 4 axle trailer he built with no brakes, at the boat ramp at the end off Lake Macatawa and pulls it a mile to the old Chris Craft plant with his 1\2 ton 1990 fwd Chevy pickup.

I literally tow my boat 2 miles on a road with little or no traffic and I do the full strap down and check the brakes before I leave the harbor. Stuff happens, I drive a lot and I've seen some pretty crazy things. I saw a truck that jumped the guard rail on an overpass hanging by it's hitch and safety chains. I may be crazy, but I'm not stupid. Throw the book at the driver and truck owner.
