if motor was not what was advertised it the sellers fault period.. dont say what you are unsure of or go by somelse word when u are the one selling it.. just my .02

Pretty convoluted deal, If seller sells motor as FRESH, ZERO HOURS and its NOT then no matter what the price he deceived the buyer. Now, on the other hand for only a 1000$ unless someone was on crack or your best friend they are NOT going to sell you a fresh 400+ hp BBC for that price , I recently sold a 1979 BBC 454 peanut port core motor from a Suburban for 500$ in comparison, Smitty

If I had sold that motor to the guy and it was not as advertised I would have given the guy his money back period. It does not matter that the seller may or may not have known. If he did not know then he should have stated in the add that he thinks it is... or maybe it is... or I was told but don't know... The good news is that if the motor is good then your buddy can probably sell it if you put it back together as is. I would just drop the pan, see what kind of rods are in it then put the pan back on and see what you guys can work out. If the seller does not do the right thing then try and sell the motor using the correct information and out the seller so hopefully no one else gets burned.

I am sure if it was a local deal, that would not be an issue, the seller IS an honest guy, just may not have known for sure what the motor really was. Problem is the distance now.
