Hypothetical rip off?!!

So....hypothetically speaking.....

You list something in classifieds.

I buy it.....send pmt.....but you are slow to ship (1 extra week beyond pmt)......so you agree to pay shipping.

Now, when I paid you, I sent the full amount....but put the paypud fee on recipient....so now you are short on that and shipping.

A couple of weeks go by because I am on vacation, but I see the package upon return.....and open it. Although it is exactly as you described it, I tell you I don't want it and to refund the money to me along with shipping for the "p.o.s" if you want it back.

Extra ripple......let's say it an electronic device.

I email you and pm you "privately" so as not to embarrass you on oso.

You find out that even before I contacted you, I started a dispute with paypal......and by now....I have your device and your money.

What would you do?

F-2 Speedy 10-06-2014 07:33 PM

if I followed all of this hypothetical situation  you have your money back and the POS that was sent you ?? send the POS back and chalk it up to another POS trying to sell a POS

Crude Intentions 10-06-2014 07:35 PM

Go to the beware section and "hypothetically" post the member and the whole story. This could be a seller beware. I know many people including myself have dealt with you on here and how fair and honest you are. So this other person is to blame, no doubt.

phragle 10-06-2014 07:54 PM

Give me a few..I need a drink or few to make sense of that.....

smokin' gun 10-06-2014 07:54 PM

yup I would have to agree cant see ( rich ) being at fault . always been more than fair .

Rookie 10-06-2014 08:41 PM

Let me understand this. Seller was slow to ship so he paid for shipping, he got shafted on PayPal fees, you got part "Although exactly as described" now you don't want it, so you then took his money and still have the parts? Did he say he takes returns?

Am I missing something?

Speedracer29 10-06-2014 08:55 PM

I'm en route to Cape Coral.... Please have pictograms or a dry erase board ready. I'll pick Phragle up on my way through Ohio. Phragle, pack beer. We will either be drunk, or have it all figured out by then. I'm guessing the former, but miracles happen.

Seriously though, I'd politely ask whoever the frack has the device to return it on their dime (with a tracking number), and if they didn't, I'd meander over to the "Beware and Stolen" section.

Pwraddr 10-06-2014 09:01 PM

I don't get it either....if it was as described why don't you want it??

JasonSmith 10-06-2014 09:06 PM

UNICEF sells parts?

Speedracer29 10-06-2014 09:13 PM

Rippling electronic device.... My old lady keeps one in her sock drawer.

mike tkach 10-06-2014 09:31 PM

wow,you need to be a judge to figure this one out.cam you please explain this so us dummies can figure it out.

commandersander 10-06-2014 09:31 PM

Reverse it.

I sold the inverter. I was late to ship. I covered shipping. Got pm, item not as described....gimme my money back......and doing me a favor by doing it private.
Then looked in inbox, paypud case disputing charge.

Out 200, out shipping, out the inverter.....

I don't like any of this. Everyone here has been great. This trans sucks. I told dude return and I'll refund, or I'll send the control panel.....an oversight....but no reply. Next I know....he won't ship if I don't pay, I loose the 200 (not including the fee) and the part.....as of today.

Kinda bent, more disappointed. Please....tell me my next step. I really don't want to turn this into another oso drama-casm.....

It's easy for me to act on the behalf of others......but I have this puzzy in me that prevents me from kicking the crap outta my own yard......live and let live sorta shat

phragle 10-06-2014 09:46 PM

So much for the drunken road trip......

commandersander 10-06-2014 10:11 PM

Road trip still good.....I got lunch.....jackazz

phragle 10-06-2014 10:15 PM

Woohoo!!!

Cole2534 10-06-2014 10:16 PM

Well, I dunno. I always thought it best to do biz like that when I had the time to dedicate to it. I know, I know, not saying stop your life to sell schit on OSO, but I really doubt that $200 was going to make/break your vacation.

And I really don't get why you're out both. Don't you have to return the items after you've determined their unfit? Hypothetically.

buck35 10-07-2014 09:40 AM

Rich, that really sucks azz. You went out of your way for me and my buddy when we were in town last week. Why do people have to be like that!

phragle 10-07-2014 10:31 AM

Will do Boss!!!

SS930 10-07-2014 11:17 AM

This is why I try to avoid using Paypal... I've gotten burnt like this a couple of times. I know a couple of other guys on here that have been burnt the same way.

Unlimited jd 10-07-2014 11:26 AM

Rich I hate to say it, but your phucked. I had the same thing happen. Luckily I had no money in my PayPal account. So each time there collections department calls I politely tell them I will absolutely refund 100% of the money when they get my part back to me. Until then PHUCK OFF.

fastdonzi 10-07-2014 11:27 AM

I want to see the Device in the "Sock Drawer" Its Big Isnt it?? Now to the Matter at Hand, This type of Sh*t pisses me off bad. When people cant keep their word it makes me want to punch them in the Face...Repeatedly.....Each hit harder than the previous one Grrrrrrr......FFFFaaaaaakkkkkkkk

low_psi 10-07-2014 12:23 PM

Paypal Fs another seller... Imagine that.

You're not out $200 AND the shipping and inverter. You're out the inverter and shipping(which you admit you covered because of your shipping delay).
You also admit that you forgot to include the control panel which was apparently part of the sale.

I understand mistakes happen, but it sounds like they were made by you. Send him the control panel and a check to cover the return shipping.
Tell him that he can either ship it all back and cash the check OR tear up the check and keep inverter/control panel.

Wally 10-07-2014 03:51 PM

commandersander, if you are the seller, i would just send him a prepaid tag via paypal to ship your stuff back....and if doesn't arrive with in a week or so, then get some local OSO boys to stop by his house and pick it up for you....not worth loosing out everything.

And IF you were the buyer....i would say send back the stuff at your expense since its the right thing to do! you got your money back now send the item back. Since you didnt see the stuff in person before purchase, its on you to accept the parts as is! This is not a retail purchase where you can just go back to the store and get a refund....its more of a garage sale item...as is where is based on another persons word. And there didn't seem to be a reasonable amount of back and forth communication as to any kind of resolution leads me to believe this is not the first go round with getting a paypal refund for something you bought! :(

just my hypothetical rant ;) please don't take offense to it

GLS 10-07-2014 04:36 PM

So who's who in this story

Now you know three!!!!!

For me, the inverter and cash don't mean anything to me.....

ITS THE PHUCKIN PRICIPAL!

commandersander 10-07-2014 05:35 PM

I'm who sold. Posted pics in the classifieds.....new in box.....never used.....

The box sat in my forward cabin since new.....never got around to hooking it up.

This is the xantrex model with a telephone jack that allows remote monitoring of the status.....if you so desire.

I shipped it late....(1 week) and apologized......along with the offer to pay shipping (38 if I remember correctly)

Buyer decided to pay originally with fees pointed at me....so I didn't even get the full 200.

Two weeks later, I get a long winded pm here about how it's dirty and he can deal with dirt, but it doesn't work. I told him ok, ship it back and I'll refund....or.....I'll send the control panel.

He said if I want it back, I need to send him money for shipping......I said no....so....do you want the control panel.

Now I look in paypal (they sent me an email) and I am almost 200 in the negative...and need to make a deposit.....or go to collections....

Once I saw he filed a case, no way I was chasing that.....especially because he did it before contacting me "privately " so as to save me shame on oso....considering I had so many likes....

So......yes.....I'm out the part, I'm out the shipping.....and I'm out the money that was in my paypal acct.

From buyer....daleroger

I see you are online, you said you would ship the panel on Wednesday, and no response. What's the deal. I have been more than patient on this deal.
Either refund my 200, plus 25 for shipping if you want the thing back, or if you have the panel, and it's in good shape, send it. If nothing happens by Monday, I will advance the paypal complaint to to resolution and let them decide. Since you had to many likes on OSO, I thought you were a man of your word ,

My response:
I am growing tired of you. My last pm to you was, "so send the panel"? No response until just now.

Without challenging whether or not I have dignity, I hand it to you as a final opportunity for resolution....

Ship it back and I refund.
or....
Approve shipment of the control panel, and I will.

You continuously state that you are doing this in private.....giving me a chance.....going out of your way....

Relax. Take option one, or two. I don't care either way.

You made a case with paypal before you EVER contacted me with an issue......meaning.....the two hundred is already gone from this side.....and shipping.....and the inverter.....

So I'm out 235 cash plus the part. Are you looking for sympathy from me? If yes, wrong door. Try the next one.

Crude Intentions 10-07-2014 06:19 PM

Note to never deal with him. Everyone and anyone understands we all have lives and things to do. If I bought something and it took a week to ship that in and of itself wouldn't piss me off as long as the comm lines stayed open.

I mean with a simple ship it back and you're refunded should have settled entire dispute. End of story. Can't ask anymore of a seller who says send back and ill refund.

Exactly. Phuck paypal. I send checks to the seller and expect them if I'm selling. If I'm going to get porked I want it to be the old fashioned way. Everyone on here and a few other sites I frequent haven't f'd me yet.

To date I've been boned $3200 using PayPal. The last 200 was a chart plotter sold on tht. Guy insisted on paypal and I caved......I had a friend bill him for me. Sure as shat......as soon as he got it he said it's not as nice as he hoped and disputed charges even though the plotter was exactly as described and pictured. I partial refunded 200 just to have him f off so I could move on. ....
Other $3g was from motorcycle parts years ago.

Crude Intentions 10-07-2014 08:40 PM

Basically any form of online purchasing/selling has its merit to be screwed. Hell in person people get screwed. It sucks, it's part of life and it will happen to all of us at some point. With a forum like this a lot of that is minimized. Yes it does happen but I bet nowhere near as often as places like eBay and cl. I like PayPal and will continue to use it. Stories like this is how we know who to avoid.

buck35 10-07-2014 09:04 PM

Ive made 3 transactions in the last 2 months, each time I sent a check, told seller to cash and send merchandise, no problems so far. I think ive been lucky, but I'll give someone a chance and if they screw me I'd definitely let people know.
Why do folks have to be that way? wtf! We're all brothers on here, some with money, some not so much, but we all love the same thing.my 02.

TriPaC87 10-07-2014 11:00 PM

PayPal is an eBay company and from what I know about eBay complaints-- the "complainer" has to try to make it right before they file a complaint. He didn't do that. So if I were you I would call PayPal and tell them what is going on. If he lied and didn't contact you before filing the complaint, then use that to your advantage. Then make a PayPal return-to-sender shipping label (for free) and e-mail it to him. If he wants to make this easy, he can print it, slap it on the box, and ship it. If he does end up shipping it, you pay for the label. But in the end you get all your stuff back and can try to sell it to someone else. Yes you will be out the shipping money ($70ish bucks) but at least you won't have to deal with that azzhat any more.

commandersander 10-08-2014 07:13 AM

^^^^^^^^^^^^^^^^

I think I will try that.....

Good luck with that one! I run a web site that sells equipment for treating sleep apnea. One of the products that we sell is a DC battery to run the machines. They have a 1-year warranty. Had a customer call me 3 years after buying one to tell me his won't work - bad cell in it. Could have told him sorry 'bout yer luck, but offered to sell him a replacement at our cost and ship it free. Instead, he orders another one from the site, we ship it, and a week later he files a "not as described" claim with PayPal and SENDS BACK THE OLD ONE. These things have serial numbers on them, and it was obvious that he had opened the case on it, so we sent PayPal a bunch of pictures to document our case, along with screen images to show that he had bought one 3 years ago and was shipping back the old one. Didn't matter - PayPal ruled in his favor. We do $70K plus per year through PP with NO other claims besides this one. Doesn't matter - PP is totally tilted in the buyer's favor. And good luck trying to communicate with an actual human being at PP - if you do, they will be in New Delhi.

Major credit cards are almost as bad if you are the retailer. It is so easy for customers to file a chargeback basically on a whim. Unfortunately it almost always is ruled in their favor, and the retailer is on the hook. It's no big deal if you are a huge corporation like WalMart, but for little guys like me, it's like death by a thousand daggers.
