Why should he lose his deposite.
1) the boat was misrepresented and prostock had to find out about damages he was never told about through reading it and seeing pics on boatfreaks.
2) he attempted to pay in full monday, just one busness day after the contract expired
3) he was promised a survey by the seller and it never arrived, although he was told on numerous occasions by the seller it was on the way, or in the mail.
he should get all 14k back and then some

# 1 and 3 are what I am saying!! he should get the whole thing back. LDD broke the deal right there so no deposit should be lost

I just received word that both parties are no where close to the same number figures.LDD is still claiming that waiting till Monday to discuss the deal after he sent PS a email on Saturday asking PS to wait till Monday because of fathersday Sunday caused him to lose thousands of dollars.
Even if PS would have paid him on Monday via a wire transfer he would still be out thousands(so LDD claims). So he wants PS to make up the difference of what he could have sold the boat for and what he claims he actually sold the boat months later. He just doesnt get it.Its up to PS from here but if it was me i'd be on the phone today with the attorney, enough is enough.

If it was me personally I'd definetly give it all back! But since duck is not a person of character, there has to be some comprimise in order to end this nightmare and IMO only, that 2K should easily be the most comprimise Prostock should settle for.
Again a person of character would not think twice about refunding the whole 14K but this isn't what Prostock is dealing with.

We don't know that because we do not know if Dongers business is set up as a DBA or a Sole or a corp....

First things first. At 11:00 am you said you made $3500 today. Then you said you finished 5hrs. early and let it sit in the water for 3 hrs., then re-shimmed it. WOW, you must get up early in the morning!! Or are you saying that you got your check today for the work performed and made a $3500 profit??
I can't say if I would have signed that contract or not. If I had a strong desire for that boat, if it was in my price range and no others were available, I may have been coersed/pressured into signing it. If there were comparable cats of the same brand or others, probably not. I'm not saying he was pressured but a pro salesman would know how to push the deal through!!!
