I asked the question. does not mean i think it will happen. but let face it.

a you-tube video that cant show the vessel number, or the registration is just that a you tube video.

legally they cant prove he was the one in the video.


also on the insurance comment. just cause you do something stupid does not mean they don't cover you.... people drink and drive. and insurance still has there back. that's why once you get one you pay our your ass, same with tickets. this guy was at the wrong place at the wrong time, but accidents happen.

also he made it back to the dock, so again how you going to prove its HIS BLACK 43 DONZI that was in that video? granted we all know, and they will know. but in court its what you can PROVE. that goes for insurance, and warranty's.

its not against the warranty to take int he ocean is it?, or go over a wave? do they nomericly limit the size of seas the boat is covered? if so , again how you PROVE this was the boat in the video, and not someone else? unless he has hospital bills, tow bills Ect from the same time period/ place. but still does not PROVE with out a doubt it was THAT boat in the pic. with out the proof the video is through out of court is admissible evidence. and thus you have a boat, that was in the ocean and broke in half...

for instance. a you tube video of a silver C6 ZO6 slamming the **** out of front end after a burn out at a drag strip.

that does not mean every silver ZO6 cant file a claim cause there is a video of one doing something stupid, on a track. unless there is evidence proving it was A CERTAIN silver vette, on a track (which normally give insurance an out) doing it then you can say it was not you. and prove your case the other way.

Does Donzi still actually exist?? is it the same Donzi that existed last week/month/year?? Isnt Donzi in the middle of the foutain/baja/proline shell game with people fighting over who has the rights to fle bankruptcy?

Why TF should Donzi be expected to pay for that? It was an accident. His insurance should pay but they will no doubt try to weasel out of it. Especially if it's Progressive...

I asked what do you think will happen. again no PROOF this was the result of that video/negligence.

Donzi is (actually was) semi-custom and they do a lot of one-offs. There is only one boat like that one so your silver 'vette reference is moot.

Our court system follows a reasonable standard. Even without the video it's pretty reasonable that the boat was abused in some way.

there is more then one 43 black widow donzi.

the video does not prove trips, or twins. and would be completely debatable in court. just saying.

And how many black widow 43ZRs are in CA, yet even San Francisco? What did the passengers say at the ER room? How were the medical injuries covered? If CA is anything like NY, there's already been police intervention, especially if there was an ER visit due to a boating related accident. Are any of the passengers suing the driver? Probably. This one is unlikely to get swept under the carpet. It's an expensive boat, and it damn near broke in half. It's going to get lots of scrutiny by the insurance company before that claim is ever paid off.

His insurance WILL pay. The guy didn't do anything other than get caught up in a bad situation. When the customer is an imbecile the insurer can't just deny the claim. He wasn't participating in a sanctioned race, poker run, operating illegally or competing in a wave jumping contest. Hitting a huge wave on the ocean and damaging your property is certainly covered under any legitimate policy.
