Just watched a nasty divorce from the sidelines...... I was the best man in the wedding and in the end I got subpoenaed!
Husband bounced through jobs, wife had a 30-35K job for 15 years. They had no money, nothing to split buuuuuutttttttt the husband owned the house before they got married and she was never on the title. She was entitled to some of the appreciation but didn't want to "deduct" the mortgages/the damages the house had (leaky roof). Wife has a new leased small SUV, husband's truck died in the driveway, he has driven company rental cars for months (some months he has to reimburse $800 for the rentals, other months it is only a couple hundred). His lawyer nailed it: In open court: "My client was a rotten husband and this couple lived beyond their means for essentially the whole marriage and have no real assets!" Net Net: she got 30K, lawyers got 75K+ and everyone lost their sanity over the last 5 years. He has to pay a couple thousand in child support for 8 years. Game over, she lives in an apartment and he still owns the house. His next raise should erase the child support costs completely so he looks at it as being in his house and she is gone for 30K.........the lawyer fees are sunk money. Funny point in the case: He offered 10K for her to move out (apartment first, last, security). She declined. Her lawyer comes back to the negotiate a few weeks later and starts talking like the 10K is still there. Husband's lawyer stops him and says the 10K is no longer there. Lawyer freaks and asks where did it go? His lawyer kept $7500 for fees and sent her lawyer $2500. So he says didn't you get the $2500 I sent you? :D Wife frowns realizing the pot just shrunk 10K more...... |
Know very little on this subject but 30 yrs ago, in my divorce I learned about “no fault divorce” states.
In Ohio where I lived, attorney told me, basically they dump everything in a pile and divide by two. On the no fault part, I asked, if I come home and catch her w/the mail man, grab a camera and tape them together, this changes nothing? He said....,correct. Never forget that. I hate seeing a partnership, union fail. But if so, best of luck to you sir. |

I bought a cruiser in the middle of my divorce!
Financed it and had good enough credit to get all but I think a grand. Knowing her attorney would come after it. Which he did. She told me they were taking 1/2 of my new boat. Told her, good luck. Its all financed and all I’ll owe you is 1/2 of the $1k down payment. Never brought it up again 😉 Funny story about it. Docked it at a very nice marina on Lake Erie. They had a season opening party at its private bar that spring. My dock neighbor who I had gotten to be friends with was there and every five mins would come up w/someone new to introduce me to. Always introduced me as, the guy I told you about, that just got the divorce. After the 3rd or 4th time I quizzed him on it. Told him I’m confident in who I am at this point in my life and not embarrassed by my divorce. He felt terrible and apologized then explained. Said at that marina they normally see the guy doing well for himself, buys a nice boat then starts bringing his secretary up for the weekend. Wife busts him and takes the boat and he disappears. He said, you on the other hand......, you wait for the divorce then buy the boat! They thought I was a genius. Spent that first season doing my best at taking a different hotty up every weekend. Always told them to bring the brightest bikini they owned. When wed leave dock I’d hand them a coil of line and tell them to stand on the bow and act like you know what you’re doing. When leaving the harbor, all the old duffers would turn their deck chairs around to watch us idle by and wave 😎 That was the highlight of my divorce. |
Cash and bank accounts that are joint can be cleaned out with no retribution, so if you have cash and such or a large amount of money in a joint account at least take 50 percent, or 100% can be taken and you have no recourse. depending on the state, pensions can be divided by years of marriage, if any kids under 18 child support wil be based on a formula or table based on salaries and contribution to the household. if you have large assets, then consult an attorney and don't do anything illegal. its just not worth it.
