Spring Lake Township Ordinace ruled unconstitutional
October 12, 2007 Grand Haven, MI
The District Court in Grand Haven ruled the Spring Lake Ordinance Disorderly Conduct by Disturbing the Peace/Loud Music unconstitutional. The Court ruled the langauge of the Ordinace was vague and did not put people on notice as to what conduct was prohibited as unreasonably loud and raucus were not adequately defined.
This means that the misdemeanor charge of Disorderly by Loud music cannot be enforced in Spring Lake Township. The Township will have to rewrite the ordinace to be more specific if it wants to enforce the noise ordinace.
The client who was facing upto 93 days in the county jail as well as fines as much as $500.00 plus court costs has been vindicated and his record will remain clean.
The Court ruled that the ordinance was vague and the term unreasonably loud or raucus noise did not give proepr notice to individuals on what noise level would violate the ordinace.
This past summer our client who had a house boat on Hanky Panky Bayou with speakers allegedly playing music was arrested and taken to jail. The complaining witnesses were homeowners on the bayou. This applies only to the ordinance effecting Spring Lake Township only. it would not affect Grand havens or any other municipality.
Congrats to our client and our attorneys at the Barrix Law Firm who worked so hard on protecting the Constitution of the State of Michigan and the united States.

I had a similiar incident for the first time on Higgins Lake this year. Pulled over twice in one day, 1 for speed (going 45-50 tops and sayed I was too fast) and 2nd for noise but only said I was too loud and never tested and no tickets issued. Wonder if these enforcements are starting to make there way everywhere?
Older guy in the Four Winns runabout? He popped me last summer. I will not be going back to that lake!

Parnell and I had a meeting with the Sheriffs before the end of the season and they understood where we were coming from. Hopefully this year will be different! Just got to hope for the best!! Also found out that someone on this site that lives on Spring Lake has been feeding all of our posts to Mr. Dykhouse personally. He reads everything we are saying so I would watch what you say so that little ***** doesn't go whine to him again and he gets even more pissed off!

Yeah, I think it was the same older officer that pulled me over last August on a Saturday. I didn't know the lake as it was my first time out on Higgins. I was only doing about 45-50mph...just following a friend (Articfriends/Smitty). Smitty had to come off plane and shut down for a moment to check something under his hatch so, I shut down as well as I waited for him. The marine patrol in a little Four Winns with the older officer came over to us and wanted to see if we needed any assistance. He then mentioned something about hearing us as we were coming across the lake and wanted me to start my engines for a moment as he drove around the stern of my boat and reminded me about the 55mph speed limit and asked me not to go too close to shore so as not to rattle the residence. He didn't use any sound test equipment (not sure if he had any or not) and no tickets.....he was actually very friendly towards us. We then went over to the sand bar of some park/beach area and tossed an anchor for a few hours in waist deep water near some cove inlet. It was a pretty overcast day and not much boat traffic out at all. After about 30 minutes of being anchored the same marine patrol boat with the older man came over and sat out in front of us just outside the shallows about 50 yards away and just sat there for about 45 minutes or so and at about 6pm he started up and headed for the other side of the lake. I guess his duty/shift had expired. We left around 7pm and didn't see the marine patrol or barely any other boats for that matter as we cruised across the lake at about 55mph toward the boat lauch site.

Yes, the older officer in the Four Winns was the same that pulled me over. I too did not recieve a ticket nor did he have any sort of measuring device to check for noise but I am sure they will be looking into in soon.
So I am aloud to have switchable exhaust as long as the tips are muffled? And if tested, I can have it on the silent choice?

Like I said, I will never go back! I used to go to Higgins 6-7 years ago and there was easily 3-4 times the boats on the sandbar and a lot of go-fasts. Now I know why!
Luckily, I have closer lakes to me that are better than Higgins!

You can have switchable tips. If you have straight pipes with pneumatic flappers that you can actuate remotely or automatically, and introduce water in as a baffle "wet exhaust" to "muffle" the sound it is legal as long as it passes the 90db. Switchable exhaust "captains choice" is not illegal.

You should have been given 2 tickets KAAMA
One for each motor. 5 " open exhaust, You should be ashamed. But I still think my T/G is louder.

KAAMA, I have seen you a few times, once at higgins lake running with a Baja 272 at the west boat launch. I think the day I saw you, you had a sterndrive problem ?? Also, passed you near Indian River somewhere over the Labor day weekend.

Well, if you saw me on Higgins, then that was the only day I had ever been on Higgins...my first time! That Baja I was running with was Smitty's aka Articfriends boat. Yeah, that was the day I busted a U-joint on one of my drive shafts just before we got back to the boat launch. Yeah, was up at Cheboygan for Labor Day weekend...excellent boating up there!
