DWI No Refusal program begins tonight

With spring break, the Houston Livestock Show and Rodeo and St. Patrick’s Day expected to bring significantly more impaired drivers to Montgomery County roads this month, the Montgomery County District Attorney’s Office and local law enforcement agencies will increase DWI patrols and prosecution efforts, the DA’s Office said.
The primary purpose of this program, which begins at 10 tonight, is to ensure the safety of the public on Montgomery County roads by letting potential impaired drivers know about the consequences of driving while intoxicated, according to the DA’s Office. The goal is to minimize DWI incidents that inevitably lead to deadly crashes.
The program will use mobile breath alcohol testing units (BAT) provided by the Houston Police Department, blood technicians, prosecutors from the District Attorney’s Office and police officers from the county’s various law enforcement agencies.
Judges Jerry Winfree, Michael Seiler and Kathleen Hamilton will volunteer their time to review warrants for the existence of probable cause for the arrest and search. Any person suspected of DWI who unlawfully refuses to provide a breath sample will be subject to blood being drawn by trained professionals if the judge agrees that the arrest was proper and lawful. The DA’s Office will provide two blood technicians to draw samples of blood evidence from suspected drunk drivers.
The prosecution will receive strong evidence of guilt or innocence as a result of this program.
The BAT mobile will respond to area “hot spots” where impaired drivers create significant risks to the public safety.
The District Attorney’s Office also purchased equipment to find, arrest and prosecute impaired drivers, including HawkEyes infrared cameras to film impaired drivers’ eyes during sobriety testing.
