Pantera needs to be stopped permanently. NOW. This has been going on for years.

I think you are missing the point. You are a working man, I have seen in other posts as you shop for a boat. Imagine if you found a boat to buy, paid $100k, waited two year and got NOTHING?. This isn't a case of a business filing against another business, that has the means to absorb the loss. THEY TOOK MONEY FROM A CONSUMER, A FELLOW BOATER, SPENT IT AND DELIVERED NOTHING.....100K! How in the world can you defend this?

Let me break it down for you, this is common pratice for businesses that live beyond their means.

1. Take down payment to build Berk's boat
2. Use money for other things, bills, or to complete previously sold boats
3. Try to sell the "next" boat, to get down payment to complete Berk's boat
4. No sales, no more money coming in
5. Ask Berk for more money, for next phase
6. Pay more back bills with said money, mortgage, shop rent, elec
7. File BK on Berk.

Berk may win assesets or money from the sale of assesets in court but I doubt it. Not sure how far they got on the boat, but a boat shell doesn't pull much money in the auction market

I don't care who you are, no one should be pre-paying to have a boat built.

one incorrect statement...........

Apparently they didnt pay the rent as that is the other person listed on the bankruptcy.

One Very correct statement, and one of the mistakes Berk made..............

No they shouldn't. There should be some completed hulls in all white gel on hand and ready for customer's choice of paint & power if this is going to be a two man operation.

That MAY BE hurt? Seriously you show more apathy fo a entity that has been found guilty of fraud and been ordered to pay numerous judgements since 1992 then a/they consumer(s) shelling out 100K boats that was promised to him/they. Kicking them when they (Pantara) are down? How so? They have changed names and ownership (in family) more then one time to avoid paying judgements and routinely have used the court system to maintain their personal wealth, and shall we say, hobbies? Now they are using the courts again to what will amount to another screwed consumer who joins a list of their victims, via bankruptcy.
There are more then a "few" who think it's time they got some of their own medicine, it's many. Many more then the few left who buy into the game. Jo is consistent, he plays his cards to gather sympathy now the exact same way he did ever since the shady dealings became a routine way of doing buisness over there. Read one of his storys now, and it's the same as it was EVERY other time in many of the years past. Always a excuse, a delay, a supplier, the economy, blah blah blah.
And no I have no need to call Jo or see Jo or give Jo anything, I'm already well versed in their storyline. It's just another part of the same game of deflection he's also been using over many years many of us have seen.

The boat is the bait. Prepayment to Pantera is the trap & Berk fell right into it.

When are the assets being auctioned off? The name and webite have some value. What about tooling and equipment? You cannot file for bankruptcy without trying to pay off you debts like the $100k and counting owed to my family.

I think many are quick to defend Pantera because of the fact they gladly helped me with a 30 year old boat I bought used. I stopped by the factory and I was given the grand tour of everything. Jo took me to the graphics guy and really helped me out. How many other companies will waste there time on a used boat customer? Just my opinion. I am sure someone will write something negative about this post.

Chit !!!

Well , forget everything that's been said.

Before you posted that did you think about how many half hours Berk and Lost in Boston worked to save the money these guys screwed them out of ??
