cfischer, like DollaBill said a 38TE Fountain will flat out run a 36 Concept in the rough. Anyway I might be stirring the pot but how many people like to stir the pot on the Fountain forum or in the GD section? You need to thicken up your skin.:chill-pill: If you went through what I did with Concept and it's sales rep where they have the it's not Concept's fault attitude you would understand.

OK

So let me get this straight,

1. You purchased a new Concept
2. Something went wrong for it to go back to Factory and a employee or rep from Concept was pulling
3. A accident happend on the way, boat totaled
4. You have not made a claim on your insurance
5. Concept has made a claim but Insurance is slow (normal)

Hard call, I would file a claim with your own insurance. Get it behind you, let your insurance take the driver/company, Insurance company to court.

My test boat wasn't quads. It was trip 275 Verado's, just for the record. Look up the article. June '06

Oh. The boat ran 70 even w/ 2 people and about 1/2 tank. No other equipment. I had the first quad built for someone. Had some issues though.

Skip that the boat has quads...I just wanted to post the Fountain big water pic...thought you'd like it not miss understand it. Still a trip engine 38TE Fountain will out run a 36 trip same engine Concept...it is just fact.

The Fountain hull is farther advanced than the Concept that is all.

Although and I am sure you will not like this but the Fountain's are a more soild build than the Concept.

However the drama from the Concept rep sure is a lot more interesting...but hey we got Reggie though!:ernaehrung004:

Not if you have Luis build it with kevlar , add two stringers in the floor , add a bulkhead at the cabin entryway , and remove as much of the fluff as he will let you . :cool::ernaehrung004:

You shouldn't have to add this and add that and remove this and remove that to come up with a solid production boat. I love a 36 Concept they have great lines but a 38 TE pretty much will destroy anything in big water with their standard layup.

I've got news for ya ... there aren't any "production" boats that I would order new without making a bunch of changes to make the boat work for me ... Fountain included .... They all have too much **** screwed onto them that breaks ... and not enough structural built in .... I'll sacrifice a few mph to have a tuff boat that will do what i need it to do . All this being said , there are very few things in common between a 36 Concept and the 38 Fountain . The Fountain is a much larger / wider boat .

Haven't read everything about this but why not just take them to court. It will be a long drawn out process. In the end the judjement can include court, legal, and punitive fees. Just start writing checs to your lawyer (get a good one). If you don't have one I know one that is an awesome guy. Has sued seadoo, baja, and other corporations and won. Some went to court and my buddy won in court on a substantial case. I hate leagal involvement, but at this point I would with out a doubt open my checkbook and let it roll. You did nothing wrong and in the end the judge would side with you and reward accordingly.

Is the builder in another state? If so, it can work in your favor, as you will be able to initiate the suit in your state and they will have to defend outside their state. It will be a real loser for them, as usually they would have their attorney in their state and then another attorney in your state where the lawsuit is filed. Filing a suit doesn't initially cost much at all for your, but it will for sure get their attention if anything will.

Found out the dealer and this is a true story the dealer, owner and boat are all in Florida of course with Concept. The dealer told me Concept sent a trailer up to Sarasota to pick up the boat to bring it back to Concept to fix some problems and it fell off the trailer on I-75.

Why didn't you file with your insurance company and get your loan paid off so that you are free and clear instead of making payments on a totalled boat?

OR

Get an attorney involved...this would have been through court by now.
