Monkey Turned Loose After Fire Shot To Death

EmailPrintGRIMES COUNTY, Texas -- One of the monkeys that was turned loose during the tri-county fire has been killed.

Grimes County sheriff's deputies said one of the monkeys was sighted in West Magnolia Forest in the Plantersville area about 9:15 a.m. Wednesday.

The monkey was fatally shot and turned over to Waller County Animal Control Officer Don Jones.

The monkeys have shown aggressive behavior, officials said. A game warden was bitten by one.

"She gave him part of her candy bar, so he ate it," veterinarian Dr. Wendell Baker said. "Then she got in her car, the monkey jumped in the car with her, and, before she knew it, he bit her, took the candy bar, left and went up a tree."

The killed monkey was the same one that bit the game warden, officials said. Baker said the monkey had to be killed to test its body for viruses that could have been passed onto the game warden.

One of the monkeys stole a deputy's cellphone. He got the cellphone back, but it had teeth marks.

Jones said 10 monkeys were released by their owner because of the fire. They lived on a property in Waller County.

Seven monkeys have been captured, officials said. Two monkeys have not been found, but officials said there is a good chance that they died in the fire.

Investigators said that if someone spots a monkey, they should not feed it or attempt to capture it.

"People see these animals and think they're cute," Baker said. "He is cute, but that monkey is strong and powerful -- much more than people."

RSAS Holdings Inc., the company that owns and operates Ransom’s Steakhouse and Saloon and El Dorado Jacks, filed for an emergency motion Wednesday to convert its Chapter 11 bankruptcy filed April 14 to Chapter 7 bankruptcy, according to documents filed with the United States Bankruptcy Court for the Southern District of Texas Houston Division.

According to the U.S. Bankruptcy Code, Chapter 7 calls for the “liquidation” or sale of a debtor’s nonexempt property with the proceeds distributed to its creditors. Chapter 11 calls for the reorganization of a business to keep its business in operation and pay creditors over time.

Julie Koenig, with Tow & Koenig PLLC who is representing RSAS Holdings and its president Steve Treat, said the emergency motion was filed after the mortgage company Mara Moja Holdings Ltd. filed a motion Tuesday to foreclose on Ransom’s Steakhouse.

“We think there is a lot of equity in that property,” Koenig said. “That is why we filed the emergency motion to convert, so we can get the Chapter 7 trustee (involved) in time so if (Treat) wants to market the property, he can object to the foreclosure.”

The Montgomery County Appraisal District has the property at 300 CB Stewart Drive in Montgomery appraised at $247,660.

Philip LeFevre, with Mara Moja Holdings Ltd., confirmed Wednesday that the restaurant closed its doors Monday. LeFevre said his company was financing the restaurant but declined to release the details of the financing agreement.

LeFevre said a message left by Treat indicated that Ransom’s had been supporting the company’s second restaurant, El Dorado Jacks, near Lake Conroe and he could no longer keep both locations running.

“It was doing well and it was a very good restaurant and obviously we are very disappointed,” LeFevre said. “We are particularly disappointed because it appears that a lot of people were not paid, and that is more important than anything.”

Jim Allen, who owns the property at 15659 Marina Drive on Lake Conroe, said he changed the locks on the El Dorado Jacks building Tuesday.

A hearing on Mara Moja Holdings motion for foreclosure is set for 9 a.m. Oct. 7.

Drought effects
With El Dorado Jacks located on the lake, the recent drought may have been a factor in the company’s financial troubles.

The emergency motion stated the reason for the bankruptcy was due to the extreme drought and fact that “the lack of boating activity and lack of tourism in the area has negatively impacted the business for both restaurants.”

“We are sad to see Ransom’s close,” Montgomery City Administrator Bill Kotlan said. “It was a popular restaurant from my perspective.”

Kotlan said the city received both sales tax and alcoholic beverage sales tax from Ransom’s. He said losing that revenue will have an impact on the small community just west of Lake Conroe.

“I know they were one of our top taxpayers at one time,” Kotlan said. “But over the last few months since they have been in bankruptcy, we haven’t gotten much from them in sales tax.”

Prior problems
This is not the first time Treat has file for bankruptcy. According to the bankruptcy filing, in 2004, both El Dorado Jacks Grill & Bar and Fajita Jacks Mexican Grill & Cantina filed Chapter 11. In January 2006, those two restaurants were combined under Great Texas Restaurants Inc. Treat served as president of that company.

However, in January 2007, GTR filed for Chapter 11 but was unable to meet the obligations of the bankruptcy plan and both restaurants were foreclosed on. GTR closed in December 2008. In 2009, Treat joined RSAS Holdings and in 2010, Treat purchased the company. RSAS Holdings eventually sold Fajita Jacks but continued to operate Ransom’s Steakhouse and El Dorado Jacks.

RSAS Holdings has also racked up several tax liens and is facing a lawsuit for breach of contract. In January, Temple, Texas-based Performance Food Group of Texas filed a lawsuit in County Court-at-Law 1 in Travis County against RSAS Holdings for $13,232.46. On April 21, that court entered a judgment against RSAS Holdings for that amount plus $4,410.82 in attorney fees for a total of $17,910.83.

In addition to the bankruptcies and the lawsuit, the state of Texas placed a tax lien in the amount of $11,824.37 for unpaid employment taxes dating back to early 2010. A second lien was filed on RSAS Holdings in March in the amount of $15,763.61 for delinquent taxes.

Montgomery-based A-1 Construction Company also placed a lien on RSAS Holdings for $25,891.32 in June 2010 for work the company did in March 2010 but was never paid.

Allen, who owns the property where El Dorado Jacks was located, said Treat had been current on lease payments but had never paid the taxes on the property. Allen said he has paid those back taxes and hopes to get another tenant in soon.

If you call about the advertised price of a used car listed by a dealer in NY, they tell you a price. Yo ucan't buy it at that price though because the advertised price reflects a trade allowance of 2000. If your not gonna trade me anything, then you have to pay 2000 more. GFU.
